Culture and the Judiciary
How can jurists resolve multicultural conflicts? Which kind of questions should judges ask when culture enters the horizon of the law? Are they then called to become anthropologists? Through the analysis of hundreds of cases produced through decades of multicultural jurisprudence, this book reconstructs the constitutional and anthropological narratives and the legal techniques used by Western judges to face the challenges posed by multiculturalism: from Japanese parent–child suicide to the burqa, from Jewish circumcision to Roma begging, from kissing a son on his genitals to the claim of indigenous people to fish salmon in natural parks, the book brings the reader into a fascinating journey at the crux of the encounter between the relativism of anthropology and the endeavor toward a democratic coexistence pursued by the law. After identifying the recurrent themes or topoi used by judges and lawyers, this book critically analyzes them, evaluates their persuasive power and suggests a "cultural test" that gathers together the crucial questions to be answered when resolving a multicultural dispute. The "cultural test" is a matrix that guides the judge, lawyers and legislatures across the intricate paths of multiculturalism, to assure a relational dialogue between the law and anthropology.

Uses of First Person Writings / Les usages des écrits du for privé
This book considers first-person writing and the related questions of the formation of the self, the rise of the individual and the private/public debate, and places these considerations within a multicultural perspective. It compares the characteristics of European or Occidental personal writings (such as diaries, memoirs and autobiographies) with the written forms of personal, intimate and autobiographical self which have existed and continue to exist within various Asian, African or Near Eastern cultures. The book constitutes a call for a global history of personal writing.

Roots of Patriarchy
By combining legal and genealogical methodologies, this book describes the origin, decline, resurgence and metamorphosis of patriarchy in the West. The book provides the reader with a unified tool for understanding what patriarchy is, its dynamics, and its main features. The reader will find a guide with which to navigate the dozens of definitions and theories of patriarchy, and will better understand why, despite the proclamations of formal Constitutions of the equality of the sexes, the gender gap in the West is still high. Approaching patriarchy both as a concept and as a social fact, the book shows how patriarchy lay at the Jewish-Greek-Roman roots of Western civilization; how for millennia it was perceived as a benevolent function for social and political life and how feminism reversed this benevolent narrative. By reconstructing how patriarchy has been theorized in several disciplines and historical times, the book reflects on what has been done and remains to be done to de-patriarchalize the West. It will be a valuable resource for academics, researchers and students in Women’s Studies, Gender Studies, Constitutional Law, Cultural Studies, Religious Studies and Anthropology.

Au sommet de l’Empire / At the Top of the Empire
From the 16th century, European colonization paved the way for economic and cultural globalization and for a deep social reconfiguration. As a result, at the top of the colonial societies new elites emerged that were different from those of the old continent and the indigenous elites. European elites seem to be one of the cornerstones of the colonial system. This book highlights the diversity of elites (settlers, nobilities, Creoles, civil servants, officers, etc.) and the variety of colonial situations from the 16th century to the 20th century. Neglected for a long time, the history of imperial societies gives a new slant to colonial studies. A long-term and comparative study of empires sheds light on the origins, education and mobility of elites, their way of life and relationships with metropolitan and indigenous societies. Contributions from American, Belgian, British, Canadian, Dutch, French, German, Italian, Portuguese and Russian historians allow us to rethink the issue of colonial domination through the prism of social history.

David Ruggles
David Ruggles (1810-1849) was one of the most heroic--and has been one of the most often overlooked--figures of the early abolitionist movement in America. Graham Russell Gao Hodges provides the first biography of this African American activist, writer, publisher, and hydrotherapist who secured liberty for more than six hundred former bond people, the most famous of whom was Frederick Douglass. A forceful, courageous voice for black freedom, Ruggles mentored Douglass, Sojourner Truth, and William Cooper Nell in the skills of antislavery activism. As a founder of the New York Committee of Vigilance, he advocated a ""practical abolitionism"" that included civil disobedience and self-defense in order to preserve the rights of self-emancipated enslaved people and to protect free blacks from kidnappers who would sell them into slavery in the South.Hodges's narrative places Ruggles in the fractious politics and society of New York, where he moved among the highest ranks of state leaders and spoke up for common black New Yorkers. His work on the Committee of Vigilance inspired many upstate New York and New England whites, who allied with him to form a network that became the Underground Railroad. Hodges's portrait of David Ruggles establishes the abolitionist as an essential link between disparate groups--male and female, black and white, clerical and secular, elite and rank-and-file--recasting the history of antebellum abolitionism as a more integrated and cohesive movement than is often portrayed.
