In this pathfinding book, Bonita Lawrence reveals the ways in which mixed-blood urban Natives understand their identities and struggle to survive in a world that, more often than not, fails to recognize them.In “Real” Indians and Others Lawrence draws on the first-person accounts of thirty Toronto residents of Native heritage, as well as archival materials, sociological research, and her own urban Native heritage and experiences. Die vorliegende Studie ist eine rechtslinguistische Untersuchung zur Explizierung des textgestützten und diskursbasierten Rechtsstreits zwischen verschiedenen Rechtsarbeitern (Richter, Staatsanwalt, Rechtsanwalt) im Rechtsfindungsverfahren. Als Untersuchungskorpus gelten die authentischen Textmaterialien (Anklageschriften, Berufungs- bzw. Revisionsschriften, Urteile und Schriftsätze usw.) von sechs zusammenhängenden Rechtsfällen aus der deutschen Rechtspraxis. Die Analyse setzt sich zum Ziel, einerseits zugunsten des interdisziplinären Erkenntnisinteresses einen exemplarischen Beitrag zu der in Anbetracht ihrer Relevanz noch relativ wenig erforschten textlinguistischen Beschäftigung mit Rechtstexten zu leisten und andererseits den fachspezifischen Kommunikationsvorgang in stärkerem Maße anhand linguistischer Instrumentarien verständlich zu machen. Die entwickelten Beschreibungsansätze richten sich auf die differenzierten Sprachhandlungsmuster und die dabei verwendeten spezifischen Handlungsstrategien und Perspektivierungsanstrengungen. Dadurch wird sowohl juristischen Fachleuten als auch Laien ein transparentes Analysemodell der Rechtskommunikation unterbreitet.
